Alleged victim testifies in Cox sex assault trial

CASTLE ROCK, Colo. –The alleged victim who is accusing former Denver Broncos cornerback Perrish Cox of raping and impregnating her in 2010 testified in court Tuesday.

The alleged incident occurred inside Cox’s Lone Tree apartment during Labor Day weekend in 2010 while he was still an active member of the Broncos.

Cox initially denied having sex with the woman, but DNA evidence proved otherwise, according to court testimony heard Tuesday.

During Tuesday’s testimony, the alleged victim was asked how she felt the morning after the alleged sexual assault, to which she replied, “I had bad stomach pains…I felt different…something may have happened.”

The woman had to compose herself a few times during her testimony.

The prosecution then played an 18 minute phone conversation between the alleged victim and Cox, which took place about a month after the alleged assault.

During the conversation, the woman repeatedly asks Cox to help her figure out what happened during the night in question. “I want someone to accept responsibility,” she is heard saying at one point.

The woman testified in court that she found out shortly after the alleged assault that she was pregnant. She also confirmed the pregnancy had since been terminated.

Testimony from the alleged victim continues Wednesday morning, with cross-examination to follow.

Three other Denver Broncos could be called to testify.

Cox was cut by the team in September 2011. If convicted, he faces two years to life behind bars.

Dan Recht, a criminal defense lawyer who is not part of the trial but is watching closely, says the case could come down to perceptions.

“The law says whether or not it’s a crime depends on the state of mind of the accused, in this case:  Perrish Cox,” said Recht. “If he reasonably believed that she was consenting, even if she wasn’t, or even if she thought she wasn’t (consenting), then he should prevail. Because the question is: did he intend to rape her?”
